Parents of minors charged with shoplifting may be liable for:
- The retail value of the stolen merchandise
- The fair market value of the stolen merchandise and damaged property
- Damages ranging from $100 to $250
- Legal costs for a lawsuit or attorneys’ fees
Even if your child has not been convicted of the shoplifting or theft charge, a civil suit may be brought against him or her to restore the value of the property. Such an action can be taken to a small claims court by the owner of the stolen or damaged property, and the court may order the parents of the charged minor to pay the damages. If your teen is old enough, the court may order him or her to obtain employment to pay for the damages.
Other penalties your child may face include juvenile counseling, confinement and detention programs for serious or repeat offenders, and diversion programs. Diversion is similar to probation and may involve community service, education programs, and GPA or other requirements. This is usually only available, however, to first-time offenders.
Understand Your Child’s Options and Seek Legal Help
If your child steals or damages another’s property, it is important to contact legal representation as soon as possible. Depending on the severity of the incident, your child may face criminal charges in juvenile court. Even without a criminal conviction, the owner of the property can pursue a civil claim against you for the damages, and having our experienced Reno juvenile crime attorneys by your side can help you be prepared as you seek a beneficial outcome.
