Understanding What You’re Up Against

In the state of Nevada, drug trafficking is defined as the sale, delivery, importation, or manufacture of controlled substances. Any person found guilty of drug trafficking must have done so knowingly and the drugs in question must have been illegal. Drug trafficking is a general crime, and can be charged in a number of different ways depending on the quantity of the drugs, the type of drug, the area it was distributed, and whether or not minors were targeted.

In Nevada, the laws concerning drug trafficking are slightly different from federal laws. Where possession may be considered a separate charge federally, Nevada courts can constitute “simple possession” as a drug trafficking offense if quantity exceeds a specific amount.

Penalties for Drug Trafficking

Drug trafficking is always considered a felony, though by varying degrees. First of all, it depends on the type of drug involved. Federal law separates drugs into specific groups with the Controlled Substances Act, where Schedule I drugs are most serious and Schedule V are the least. For example, heroin and LSD are considered Schedule I drugs, while cocaine, PCP, methamphetamine, and fentanyl are Schedule II drugs.

The penalties will vary depending on whether or not the defendant has any prior convictions, what drugs were involved, and the quantity of drugs. Those convicted with Schedule V drugs could receive as little as 1 year in prison with $100,000 in fines, while trafficking Schedule I drugs could result in a maximum of life in prison and millions of dollars in fines.
