Joey Gilbert Article on Federal Cannabis Regulation Published in Reno Gazette-Journal
Earlier this month, the Reno Gazette-Journal published a special feature article written by our very own Joey Gilbert. The article – which can be viewed here – focuses on the federal government’s regulation of cannabis. As a Nevada citizen, cannabis special use attorney, and advocate for veterans, Mr. Gilbert offers his insight on the current legal landscape surrounding marijuana. In particular, the article calls out Attorney General Jeff Sessions’ suggestions for increased enforcement of federal laws against recreational marijuana, even in states where it has been legalized by voters.
In his article, Mr. Gilbert calls attention to the fact that 29 states across the country have legalized cannabis for medicinal or recreational use. As he notes, states have the constitutionally protected power to pass laws and determine their own policies, including those involving medical or recreational cannabis.
In today’s current political climate, however, some federal policymakers have expressed support for increased marijuana enforcement by the Department of Justice. This, Attorney Gilbert points out, not only contradicts the voice of citizens across the country, including Nevada, who have expressed their support for responsibly regulated medical or recreational adult-use cannabis in the democratic process, but further amounts to selectively applied federalism and an assault on our constitutional system.
The federal government plays an important role in all Americans’ lives, but that role is constitutionally limited when it comes to certain powers of states to regulate and grow their own economies within their borders. Mr. Gilbert’s article is a direct call to Congress to prevent the DOJ from spending inordinate funds on interfering with state cannabis laws, not simply because the battle to stem the sweeping tides of social sentiment in this particular case goes against common sense, but also because it is foundational to our nation and the Constitution.
