Penalties for Drunk Driving

In Nevada, DUI is a priorable offense. This means the penalties for your second DUI are worse than the first; the penalties for a third are heavier than a second, etc. It’s imperative that you take immediate action in hiring an attorney after your arrest – you only have seven days from when you are arrested to request a DMV hearing.

First DUI Penalties

  • Up to six months in jail
  • Up to $1,000 in fines
  • Alcohol awareness program

If the defendant’s blood alcohol concentration (BAC) exceeded .18%, the court may order an alcohol dependency evaluation and ignition interlock device on the defendant’s vehicle for three years.

Second DUI Penalties

  • No less than ten days in jail (up to six months)
  • Up to $1,000 in fines
  • An alcohol dependency evaluation
  • Ignition interlock device (up to three years)
  • License suspension (typically one year)

In addition to these penalties, the court may order participation in an awareness program, such as a Victim Impact Panel.
