Understanding Wills & Trusts
Two essential estate planning tools are a
living will. A will is a written document with specific instructions about how you
wish your property to be distributed at death. In your will, you can name
specific benefactors or charities to whom you wish to pass on your property.
Not only does this provide you with peace of mind knowing that your wishes
will be followed, but it will also benefit your family by helping them
to avoid the time and expense associated with probate court. The living
will is a tool that allows you to establish your health care plans in
the event that you are no longer able to express informed consent. Without
such a document, doctors and family members may have to guess what kind
of medical treatment you would want, which can result in painful family
disputes that sometimes make it all the way to the courtroom.
You may also consider creating a
trust, which can ensure that your assets are passed onto the beneficiaries of
your choosing as reasonably and efficiently as possible. Trusts can either
be revocable or irrevocable. Revocable trusts allow the grantor (the person
gifting the assets) to alter or cancel the provisions of the trust without
the permission of the benefactor. Conversely, an irrevocable trust is
a trust with certain provisions that cannot be modified or terminated
without the permission of the beneficiary. Essentially, once the grantor
has transferred assets into the trust, they relinquish ownership of those
assets and cannot undo the trust to get the property back without the
consent of both the beneficiary(ies) and the trustee. Only after death
does property pass to the beneficiaries.
