According to a report released by the Supreme Court of Nevada, on July
7, the court will review a comment regarding the state rules of professional
conduct for attorneys and how they interact with Nevada’s medical
marijuana laws. As of now, the Supreme Court is welcoming comments from
the public and lawyers regarding the proposed comment and whether other
changes to state laws are necessary.
What is the Proposed Comment?
The new comment, if enacted, will inform Nevada lawyers that under deferral
law, it is illegal to use, sell, or possess marijuana even though Nevada
state laws allow for such behavior. If lawyers do engage in these actions,
they can be prosecuted for misconduct.
Additionally, because many attorneys have become business partners and
owners of medical marijuana establishments, the Supreme Court seeks to
reach a decision regarding whether or not these lawyers should be precluded
from participating in acts that are sanctioned under state law, but remain
violations to federal law.
