A Case from the Past
One Virginia doctor focused the majority of his medical work treating patients
suffering from severe pain. His approach to help persons overcome pain
involved the use of the following medications: hydromorphone, oxycodone,
and methadone. Sources state that many of his patients were prescribed
extremely high doses of these opioid medications to control pain. The
physician was originally brought to the attention of federal authorities
when, in 2002, several of the physician’s patients were arrested
for selling these prescription drugs.
As a result, the doctor was convicted, by the jury, of multiple counts
of trafficking narcotic pain medications. Under these counts, the doctor
violated a United States Law, which states that it is against the law
for any individual to intentionally or knowingly distribute, dispense,
manufacture, or possess any controlled substance with the intent to distribute,
dispense, or manufacture. The physician appealed and stated that the court
did not properly admit evidence that was acquired in a search of his physician’s
office and did not properly instruct the jury of the law. As a result,
the physician’s convictions were removed and a new trial was rescheduled.
